If the terms of this court order are violated, the court has the power to impose legal repercussions, such as criminal charges or the removal of child custody arrangements. In addition, there are also temporary injunctions for protection, which have the same authority as a permanent injunction. The following are four types of restraining orders. Domestic Violence

To file a petition for a domestic violence injunction, the filing party much be a current or former cohabiting family member with the person accused of domestic violence.

Dating Violence

Dating violence injunctions require the involved party to have maintained a dating relationship with the expectation of affection or sexual activity within the past six months. The individual seeking the injunction must have been a victim of dating violence or have substantial cause to believe violence is imminent.

Sexual Violence

Victims of this type of sexual violence may file for an injunction after notifying law enforcement of the act of violence. This injunction can also be filed if the perpetrator of sexual violence has been sentenced to prison time, which is either complete or will be complete within 90 days of filing the petition.

Repeat Violence

To file for an injunction against repeat violence, the perpetrating party must commit at least two violent or threatening incidents against the victim. In addition, at least one act of violence must have occurred within six months of filing the injunction.
